A trademark is what converts a name you use into a name you own. Registering it gives you the exclusive right to use that mark for the goods or services you registered it under, and the standing to stop someone else from trading on the reputation you built.

Two things decide whether an application succeeds. The first is the search done beforehand — filing a mark that conflicts with an existing one wastes both the government fee and a year of waiting. The second is the class: the register is divided into 45 classes, and protection extends only to the classes you actually file in.

Good to know

  • You may use ™ from the date of filing; ® may only be used once the mark is registered.
  • Trademark classes are goods- and service-specific — protection does not extend to classes you did not file in.
  • A registration is valid for ten years and can be renewed indefinitely.
  • Registration timelines depend on the Trade Marks Registry, and an objection or opposition extends them considerably.
